By placing an order on the LA Luxury website you agree to be bound by the following Terms and Conditions.

DEFINITIONS

On placing an order through our website, you will be asked to provide an identifying document, such as a passport or driver's license. Failure to provide may result in LA Luxury cancelling your order.

PAYMENT

On placing an order, you authorise LA Luxury to charge your selected payment method in accordance with the terms of this agreement.

In doing so, you warrant that you have authority to use the payment method provided and that you will not dispute the payment with your provider.

Further, should any additional fees arise, you grant LA Luxury the authority to charge your selected payment method in accordance with the terms of this agreement. These include damages or late return fees.

In the event any payment you are required to make is reversed or rejected, you remain liable to pay this amount on demand by LA Luxury. Failure to do so will result in the order not being sent or if it already has been sent a debt owing by you to LA Luxury.

BOOKING PERIOD

You can hire each Garment for a 4 day period or an 8 day period. The rental period you have selected for your rental includes the day you receive the Garment and the day you return the Garment.

DELIVERY

It is recommended that you select a delivery date 1 or 2 days prior to the date on which you intend to wear the Garment.

Once the Garments are dispatched, LA Luxury will provide you a tracking number.

All deliveries require a signature on receipt. It is your responsibility to ensure that the address you provide us is complete and accurate, including a valid apartment/unit number, company name or any other information required for postage providers to deliver to you.

Although LA Luxury endeavours to ensure that your Garment (s) will arrive on or before your Delivery Date in most instances, you recognise that due to unforeseen circumstances and factors outside our control, your Garment may arrive late.

INCORRECT OR FAULTY GARMENTS

If you open your delivered parcel to find that you have been sent the incorrect Garment, please let us know immediately. If there's enough time, we will do our best to get you a replacement.

You acknowledge that the Garments being sent to you are not brand new and may show some wear & tear and may not appear exactly as in the photo you have seen online.

Given that each Garment is individually designed and cut, we cannot guarantee that a particular sized Garment will fit you properly. We recommend going into a store that stocks the exact garment for sale to try the Garment in which you are hoping to hire.

DAMAGE OR LOSS

If your order arrives damaged, please advise us immediately. Otherwise, we may assume that the damage was caused by you.

If you damage a rental Garment, please notify us immediately and do not attempt to repair. The damage will be assessed on receipt of the Garment as to whether or not there will be an additional cost to you.

Upon return of a Garment to LA Luxury, we will inspect the Garment and notify you within 48 hours of any damage or defects identified by us during our inspection that are beyond normal wear and tear and for which you are liable. Where the Garment is able to be repaired, you expressly authorise LA Luxury to charge the repair costs to the credit card provided by you at the time of payment.

If the Garment is damaged beyond repair, you will be liable for either the replacement cost (if possible) or the RRP of the Garment. The damaged Garment will need to be returned to LA Luxury, regardless of the extent of the damage.

If the Garment is lost or not returned, you will be liable for either the replacement cost (if possible) or the RRP of the Garment.

If Australia Post lose a Garment, you will not be liable for the cost of replacement, provided that you sent the Garment and have provided LA Luxury with the tracking number.

CLEANING

In the event the Garment is returned with a stain (including fake tan), LA Luxury will organise immediate dry cleaning. There will be no fees charged as long as stains can be removed.

You agree that will you attempt to clean the rental Garment(s) yourself, or have them dry cleaned.

If you attempt to clean a garment and cause damage, permanent damage, you will be subject to costs disclosed under the heading Damage.

LATE RETURN

If you post back the rental Garment(s) on a day after the Return On specified, late fees shall apply, irrespective of the reason. The rate of which shall be 15% of the hire fee per day.

TITLE TO RENTAL GARMENTS

At all times, the rental Garments are and remain the property of the LA Luxury. You are responsible for, and bear the risk of, the Garment from the date and time of delivery to your nominated premises to the date and time when You return the Garment to LA Luxury.

CUSTOMER CANCELLATIONS

LA Luxury will accept cancellations in the first 24 hours after an order is placed, unless the Garment(s) have already been dispatched. In these circumstances, you will receive a refund.

Cancellations will not be accepted at any other time.

CANCELLATIONS BY LA LUXURY

LA Luxury may cancel your booking. In these circumstances you will receive a full refund on your booking Fee back. LA Luxury will not be responsible for any consequential loss that results from cancellation of the booking.

USE OF SOCIAL MEDIA

You hereby provide your consent for LA Luxury to use any social media or photos uploaded by you in their Garments.

LA Luxury will offer you a 10% discount on your next hire in the event that you tag LA Luxury when posting on Social Media.

LIMITATION OF LIABILITY

On payment, you acknowledge that LA Luxury will not be liable for any loss, damage, costs, or expenses of an indirect or consequential nature incurred or suffered by you as a result of:


• Cancellation of a rental booking
• Late delivery of a rental Garment
• Non-delivery of a rental Garment
• An issue with the quality of a delivered rental Garment

LA Luxury's liability will be limited to any amount paid by the customer to LA Luxury.
